Terms and conditions of sale

By placing an order you are offering to purchase a product subject to the following terms and conditions. All orders are subject to availability and confirmation of the order price.

1. Our Contract.

When you place an order, you will receive an acknowledgement e-mail confirming receipt of your order. Unless otherwise provided for in these terms and conditions, you may not cancel or amend your order (including the delivery address, or removing items) after your order has been placed. A contract between us for the purchase of the goods will be formed when we have debited your payment method. NBM retains the right to refuse any order.

2. Pricing & Availability.

Whilst we try and ensure that all details, descriptions and prices which appear on this website are accurate, errors (including processing errors) may occur. If we discover an error in the price or payment of any goods which you have ordered we will inform you of this as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled. If the order is cancelled and you have already paid for the goods, you will receive a full refund. Unless otherwise stated: all prices are in Australian dollars, all prices exclude the costs of delivery/shipping, and all payments are due in full before we dispatch the goods to you.

3. Delivery and dispatch.

Dispatch and delivery times may vary according to availability. Any representations made as to dispatch and delivery times are subject to any delays resulting from postal delays or other events outside of our control, for which we cannot be responsible.

4. Payment.

We accept payments using any major method, including [Visa, MasterCard and AfterPay].

5. Problems with your goods.

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You’re entitled to a replacement or refund for a major failure, and to compensation for other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality but the failure does not amount to a major failure. We will accept product returns and provide you with a replacement, refund or repair where:

The product is faulty or is not of acceptable quality; or

The product is not fit for its intended purpose; or

The product does not match its sample or description.

We recommend you retain your receipt, as we may require proof that you purchased the product from us.

6. Limitation of liability.

These terms are always subject to any law which cannot be limited or excluded, and these terms are not intended to limit or exclude that law. To the extent permitted by law: NBM does not warrant the accuracy or completeness of any information on this website, or that your use of the website will be uninterrupted, virus-free or secure. NBM excludes all conditions, warranties and other terms which are not expressly set out in these terms and conditions. NBM excludes liability, whether direct or indirect, for any loss or damage arising out of, or in relation to, any errors or omissions in this website or your use of this website (including any interference with or damage to your computer system).

7. General.

If the whole or any part of a provision of these terms and conditions is or becomes invalid or unenforceable, it is severed to the extent that it is invalid or unenforceable. These terms and conditions are governed by laws of the State of Tasmania, Australia. You submit to the non-exclusive jurisdiction of the courts of that State.
